California Penal Code § 288.5: Continuous Sexual Abuse of a Child

The crime of continuous sexual abuse of a child is described in California Penal Code § 288.5. According to this law, a person may face criminal charges if:

  • The defendant lives with or has access to a child under the age of 14; and
  • The defendant commits 3 or more acts of substantial sexual contact or lewd acts against the child, over a time period of 3 or more months.

“Substantial sexual contact” may include oral copulation, masturbation, and sexual intercourse. “Lewd acts” may include any type of willful touching carried out to sexually arouse the child or the perpetrator. Under these two categories, virtually any type of sexual contact with a child is included.
